We want you to be satisfied with your purchase from Precious Moments.
This policy applies in addition to any rights you have under the Australian Consumer Law. Nothing in this policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.
Precious Moments primarily provides digital services, including digital albums, galleries, guestbooks, audio guestbooks, sharing functions and related features.
Access to a digital service may commence shortly after successful payment.
If you change your mind, please contact us within 14 days of purchase.
Where there has been no substantive use of the purchased service, we may provide a refund.
In determining whether a service has been used, we may consider whether an album or service has been configured, content has been uploaded, guests have been invited, a QR code or link has been actively used, content has been downloaded, or other material use of the purchased features has occurred.
Technical activation of a package by itself does not necessarily mean that a service has been substantively used.
We are generally not required to provide a refund merely because you changed your mind after substantially using a digital service.
This change-of-mind policy does not affect your rights under the Australian Consumer Law.
If the service does not operate as described, please contact us so that we can investigate and, where appropriate, rectify the problem.
Your rights depend on the nature and seriousness of the problem.
Where required by the Australian Consumer Law, remedies may include having the service rectified, cancellation of the service, a refund for an unused or affected portion of the service, compensation for reduced value, or another remedy required by law.
Consumer guarantee rights are not limited to 14 days and are not lost merely because you have used the service.
Packages are supplied for the access period stated at the time of purchase.
If you choose to permanently delete an album, memorial or account before the end of its access period, the deletion does not automatically entitle you to a refund for the unused portion of that access period.
Permanent deletion may not be reversible.
You should download any photographs, videos, messages or other content you wish to retain before confirming permanent deletion.
This section does not limit any refund or other remedy you may be entitled to under the Australian Consumer Law.
A package does not become refundable merely because the customer does not use all available storage, upload allowances, album features or the entire access period.
Customers are responsible for downloading content they wish to retain before the package expires.
Any rights arising from a failure of the service remain subject to the Australian Consumer Law.

We aim to review refund requests within 2 business days, although complex matters may require further investigation.
Approved refunds will ordinarily be returned to the original payment method.
The time taken for funds to appear in your account after we process a refund is controlled by your bank or payment provider and may vary.
Nothing in this policy is intended to exclude or restrict rights or remedies available under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.
